1. Definitions

 

The terms used in the Regulations mean:
  • Buyer – any entity purchasing in the Store.

  • Consumer – a consumer as defined by the provisions of the Civil Code.

  • Client – a natural person who has full legal capacity, a natural person conducting business activity, a legal person or an organizational unit that is not a legal person, to which specific provisions grant legal capacity, who places an Order within the Online Store or uses other Services available in the Online Store.

  • Regulations – these Regulations for the provision of services by electronic means within the online store.

  • Online Store (Store) – an internet service available at www.addman.pl, through which the Client can, in particular, place Orders.

  • Goods – means the product presented by the Seller via the Store's website, which may be the subject of the Sale Agreement.

  • Sale Agreement – a sales agreement for Goods as defined by the Civil Code, concluded between ADDMAN DOMINIK LIŚKIEWICZ and the Client, made using the online service of the Store;

  • Order – the Client's declaration of intent aimed directly at concluding the Sale Agreement, specifying in particular the type and quantity of Goods.

  • Civil Code – the Civil Code Act of April 23, 1964 (Journal of Laws 1964 No. 16, item 93 as amended).

  • Seller; Service Provider – Dominik Liśkiewicz conducting business under the name ADDMAN Dominik Liśkiewicz registered in the Central Register and Information on Business Activity of the Republic of Poland maintained by the minister responsible for economy, having: address of the place of business: ul. Mikołaja Reja 2/42, 50-354 Wrocław and address for correspondence: ul. 2. General Provisions

  • These Regulations specify the rules for using the online store available at www.addman.pl

  • These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.

  • The online store, operating at www.addman.pl, is run by ADDMAN Dominik Liśkiewicz, NIP 8982252686, REGON 384268305.

3. Technical Requirements

For the proper functioning of the Store, the following is required:

  • a device with internet access,

  • access to email,

  • enabling Cookies and Javascript in the web browser. The use of "cookies" is aimed at ensuring the proper functioning of the Store's Website on the Clients' end devices. This mechanism does not damage the Client's end device and does not cause configuration changes in the Client's end devices or in the software installed on those devices. Each Client can disable the "cookies" mechanism in their device's web browser. The Service Provider indicates that disabling "cookies" may, however, cause difficulties or prevent the use of the Store's Website.

4. Purchases in the Store

The prices of goods visible in the Store are total prices for the goods.

  • The total price of the order consists of the prices indicated in the Store: the price for the goods and, if applicable, the costs of delivery of the goods.

  • The selected goods to be purchased must be added to the cart in the Store.

  • Then the Buyer selects from the available options in the Store: the method of delivery of the goods and the payment method for the order, and also provides the necessary data to fulfill the placed order.

  • The Order is placed at the moment of confirming its content and accepting the Regulations by the Buyer.

  • Placing an order is equivalent to concluding a sales agreement between the Buyer and the Seller.

5. Payments

For the placed order, payment can be made, depending on the Buyer's choice:

  • If the Buyer does not make the payment within 7 days of receiving confirmation that the goods are prepared, the order will be automatically canceled and will not be processed. In such a case, the Buyer will receive an email with information about the order cancellation.

6. Order Fulfillment

  • The Seller is obliged to deliver goods free of defects.

  • The order processing time is up to 7 days from the date of payment.

  • In the case where the Buyer has chosen prepayment for the order, the Seller will proceed with the order fulfillment after it has been paid.

  • Delivery of the ordered Goods is carried out via:

  • Inpost courier company

  • Inpost parcel lockers

  • DPD courier company

7. Right of withdrawal from the contract

The Buyer has the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period expires after 14 days from the day the Buyer took possession of the last batch or part, or from the day a third party other than the carrier and indicated by the Buyer took possession of the last batch or part. To exercise the right of withdrawal from the contract, the Buyer must inform about their decision to withdraw from this contract by means of an unequivocal statement using the data provided in point 2 of the Regulations, for example, a letter sent by post or information sent by email.

8. Effects of withdrawal from the contract

  • In the case of withdrawal from the concluded contract, the Seller will refund all payments received from the Buyer, including the costs of delivering the goods (except for additional costs resulting from the method of delivery chosen by the Buyer other than the cheapest standard delivery method offered by the Seller), without delay and in any case no later than 14 days from the day the Seller was informed of the Buyer's decision to exercise the right of withdrawal from the contract.

  • The Seller will make the refund using the same payment method used by the Consumer unless the Consumer has expressly agreed to a different method of refund that does not incur any costs.

  • The Seller may withhold the refund until the goods are received or until proof of their return is provided, depending on which event occurs first.

  • The Seller requests that goods be returned to the address: ul. Curie - Skłodowskiej 55/61, 50-369 Wrocław without delay, and in any case no later than 14 days from the day the Buyer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Buyer sends the goods back before the 14-day period expires.

  • The Buyer bears the direct costs of returning the goods.

9. Complaints

  • In the case of a defect in the goods, the Buyer has the option to complain about the defective goods based on the warranty regulated in the Civil Code or the guarantee, provided that a guarantee has been granted.

  • Using the warranty, the Buyer can, under the terms and within the time limits specified in the Civil Code:

  • make a statement about a price reduction,

  • in the case of a significant defect – make a statement of withdrawal from the contract,

  • demand the exchange of the item for one free of defects,

  • demand the removal of the defect.

  • The Seller requests that complaints based on the warranty be submitted to the postal or electronic address indicated in point 2 of the Regulations.

  • If it turns out that the return of the defective goods to the Seller is necessary for the consideration of the complaint, the Buyer is obliged to deliver the goods at their own expense to the address ul. Curie - Skłodowskiej 55/61, 50-369 Wrocław.

  • Complaints regarding the operation of the Store should be directed to the email address indicated in point 2 of the Regulations.

  • The Seller will consider the complaint within a period of up to 14 days.

10. Complaints regarding the provision of services electronically

  • The Buyer may submit complaints to the Seller regarding the operation of the Store and the use of Services. Complaints can be submitted in writing to the email address kontakt@addman.pl,

  • In the complaint, the Buyer should provide their name and surname, correspondence address, type and description of the problem that occurred.

  • The Seller undertakes to consider each complaint within a period of up to 14 days, and if it is not possible, to inform the Buyer during this period when the complaint will be considered. In the case of deficiencies in the complaint, the Seller will call upon the Buyer to supplement it in the necessary scope within 7 days from the date of receipt of the call by the Buyer.

11. Reservations

  • It is prohibited for the Buyer to provide unlawful content.

  • Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded for the time and for the purpose of fulfilling the order.

  • Contracts concluded under the Regulations are concluded in Polish.

12. Final provisions

  • Any disputes arising between the Client and the Seller will be resolved by the court competent for the Seller's registered office, with the stipulation that regarding Consumers, these disputes will be recognized by the court competent according to the provisions of civil procedure.

  • In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means, and other relevant provisions of Polish law shall apply.

  • The Seller reserves the right to change the Terms and Conditions. The Seller will notify registered Customers of the changes to the Terms and Conditions via email, with the right to terminate the contract within 14 days. Changes to the Terms and Conditions take effect 14 days after notification. Orders placed before the date of entry into force of the changes to these Terms and Conditions will be fulfilled based on the provisions in force on the day the Order was placed.
